i found out the problem if you get an error msg. about a missing d3dx38.dll file your direct X files need to be updated I googled it and there are several ways to do so but i reommend using a download from hear http://pcsupport.about.com/od/findbyerrormessage/a/d3dx9_38dll-dll.htm this will work for any game with this problem

for some reason it wont work with xp it's missing a file but it works great on windows 7 just unzip in same folder and click on the app worked for me thanks
